i found out recently that a relative of a friend's aquantance's cousin was arrested for sexual assault and kidnaping cause he was trying to get a girl to have sex with him and he grabbed her arm.
How forceful the grab was im not sure but he never hurt her or took her anywhere or forced her to do anything.
But to make matters worse the girl was 16, and even worse it was his second time with a similar incident, where the 1st time he got a warning.

so he's still in jail right now and i'm wondering what kind of sentence he could be up for...

Her word against his. And the fact that she is 16 only further solidifies his fate. Even verbally soliciting someone under age for sex is a felony.

He needs to hire a really really really good IRL lawyer. That's the best legal advice you will find on here.

the guy is also an immigrant, legal, our church helped him settle in, i personally helped deliver some furniture
he has several children, one born a few days after he got to america, he has only been here for like 1 month
this is actually pretty sad thinking about him in jail, i hope our raleigh jail is nothing like those MSNBC jail shows i've seen
and his wife and kids, they must be hating life right now

Yeah, he needs to pony up for a lawyer. Even if he doesn't land in jail, if it's a conviction of any sort, it'll be enough to deport him. Because we're a border state they can actually deport him without a trial for any reason. And even if it's just two "you were arrested but never convicted" things that show up on his record, it can hurt his chances of retaining that green card. And regardless of whether it's sexual assault, laying your hands on another person is battery. And for the record--knowledge of age is not a component if the victim is underage for anything.
