So i bought a new N Router cause I thought my 7 year old B/G one was going haywire. Every night without fail, even though the lights were all operational, I just could not connect without restarting the router.

Well this new one out of the box still does it. So I ask, is it a certain setting I might have or could it be the cable modem (my own Surfboard also about 5 years old, also shows everything fine lightwise)

It could be your cable modem or the condition of the cable lines and any traps that might be between you and the street.

oh i thought it might help to mention that an xbox and server are wired and don't lose connection and that only my laptop cannot connect wirelessly without restarting so its not like the connection is dead its the actual wireless function of the router, once i restart it though everything is golden but its every damn day

interference? what channel is the wireless on? What's the model of the old one? WRT54G ? You could possibly put dd-wrt or tomato and do a site survey. I'm sure there are downloadable options that will accomplish the same thing though.

Also, you've removed the router as a variable have you another laptop and/or wireless card to eliminate that as one?

yes my gf has a laptop as well that cannot connect most of the time, we end up stealing the neighbors most of the time and using the server for torrents only

Does it get an IP, but just does not seem to connect to websites, or does it seem to be an issue with dhcp on the wireless link?

It's weird to have those symptoms follow your new router. Assign the wireless card a static IP slightly outside of your current DHCP range? The following might be your default setup, but without knowing current ip scheme 'start > run > cmd > ipconfig' it's tough to say for sure.
