When I read "soon-to-be pre-med student" and "breast augmentation" I just assume that she was going to do pre-med for 3 or 4 semesters, get serious with a cute guy planning on being a well paid doctor, and then switch to an interior design major and pressure him to get married.

although I think I support a ban on malpractice suits against plastic surgeons, or at the very least a strict interpretation of the risk of loss clause. It wasn't the Doctor's fault she was so obsessed with being "beautiful" that she made the irresponsible decision to go under the knife and "improve" herself... and I don't think, aside from gross negligence, that the Doctor should be held responsible for her gamble.

If she dies as a result of the Dr. botching the surgery (such as giving the wrong anesthesia) then yes, the doctor must pay up. No matter how elective the surgery is, the Dr. has an obligation first and foremost to do no harm. giving the wrong anesthesia or an improper amount of anesthesia falls directly on the doctor's shoulders.

However, if she failed to disclose an adverse reaction to the anesthetic, or did disclose but elected to have the surgery regardless, then the Doctor should be in the clear... however in many present cases, the Doctors still can lose even when such facts are present... thats where I think medical malpractice is out of hand...

plus the very high chance nobody had a clue about the anesthetic problem beforehand. i stopped breathing and was about 30 seconds from dying once due to some issues when i was put under for nose surgery (not a nose job, it was fractured)
