3/7/2008 1:35:59 AM
if ur permit tag was hangin that's all you need to sue them anyway
3/7/2008 1:36:39 AM
i cant prove that shit. they can easily slim jim my car and knock that shit out after i fucking call them
3/7/2008 1:38:39 AM
call them and they should bring it back
3/7/2008 1:39:40 AM
yeah, well, i want to be armed before i call their asses.
3/7/2008 1:42:56 AM
i dont really need what i wanted out of my car... i should just deal with this shit tomorrow.
3/7/2008 1:46:59 AM
yeah i had a friend that towed in KP. i witnessed him break into many cars and knock the permit into the floor and take the car.thats the shadiest business on earth (besides legal)
3/7/2008 1:48:17 AM
i'd get a ride there with a digital camera, wouldn't call first either. there's a small chance they were dumb enough to either:1. not find the permit to begin with2. see it, ignore and tow, and still leave it in the carsnap the pic of the car sittin in the lot, all you need[Edited on March 7, 2008 at 1:49 AM. Reason : towing companies suck... plenty of personal experience]
3/7/2008 1:48:47 AM
^^ a lot of them have that device that can open doors, then they take the permit offI've only heard of shit like this occuring at KP
3/7/2008 1:50:19 AM
^ Someone needs to videotape this phenomenon in action and send it to WRAL
3/7/2008 1:52:15 AM
yep, they've got my fucking carthey said i can take it up with my apt complex... dont need it right now, so i'll wake up and the the apt complex to get my fucking car back, or i'll just go ahead and file that complaint with the attorney general for not fixing my fridge 3 days after i put in a work order fucking dick heads.anyone remember the signage requirments? the signs here look smaller than what i thought was required...[Edited on March 7, 2008 at 1:57 AM. 3/7/2008 1:57:24 AM
^ why are you worried about the signs if you have a permit spot?did they switch from the window stickers? Don't want to get busted next time I'm there[Edited on March 7, 2008 at 2:00 AM. Reason : .]
3/7/2008 1:58:45 AM
illegal towing by improper signage is a fuck load easier to prove than them knocking my fucking permit down.

Call the better business bureau. Friend of mine got towed by one of the companies hired on Hillsborough St. because of predatory towing, and he called them and they sued the company and the city on his behalf. Obviously this is a slightly different situation, but it still sounds like recklessness on the part of the towing company.
3/7/2008 2:02:07 AM
yes also get the court form for towing (i'm looking for the pdf of it)
3/7/2008 2:05:24 AM
got it
3/7/2008 2:07:49 AM
no there is a small claims court form were you deposit an amount with the court and your car must be instantly released from the tow lot for no charge...Then you go to court to fight for the deposit, which from what I've heard the car owner typically wins.
3/7/2008 2:10:26 AM
just got back from measuring... 24 by 18, bitches[Edited on March 7, 2008 at 2:14 AM. Reason : got pics, too]
3/7/2008 2:13:09 AM
^ you're still going to have to go to court trust me, unless wolfcreek works something out for youThis is what sucks about tow companies, even if they aren't following procedure they have your car so it becomes your problem to prove it to someone. Hence, they can hold your car until this happens or you have to pay then try to get the money back.[Edited on March 7, 2008 at 2:17 AM. Reason : .]
3/7/2008 2:14:44 AM
well, tehy can bring my car back or i'll call the fucking police
3/7/2008 2:15:47 AM
sorry, but they will laugh at you
3/7/2008 2:20:28 AM
so barbours said its the properties fault, RPD said to call the taxi cab inspector in the AM, take what evidence I need... done. and handle it in court.either way, i'll get my fucking money back. and give the towing company a headache.[Edited on March 7, 2008 at 2:23 AM. Reason : she didnt laugh, she was rather helpful][Edited on March 7, 2008 at 2:24 AM. Reason : ]
3/7/2008 2:23:06 AM
alright, here's my game plan... use that lien form to release my vehicle, then slam their asses if they contest it.this way, the signage isnt changed and if i hear of people being towed from here i can help them out
3/7/2008 2:30:43 AM
1.) Print out poster-size pic of sign with you holding a measuring tape up alongside it.2.) Save that receipt along with the towing & taxi receipts.....3.) Profit.[Edited on March 7, 2008 at 3:42 AM. Reason : .]

I like to drive as slow as humanly possible when a tow truck driver gets behind me. They try to play it cool when they're taking your money, but you should see how easily they get agitated when you're wasting their time. Time = Money I guess. Shit's funny though. More people should do it. Two cars, tag team, 25MPH down Avent Ferry would be nice.[Edited on March 7, 2008 at 8:02 AM. Reason : l]

3/7/2008 8:11:51 AM
i think that it's pretty iffy to do that. especially when you consider the fact that every tow company in the city is on a rotation with the police department.they could be on the way to pull a car with murder evidence in it. or to pull a car out of a wreck thats blocking a highway. so i'd be careful, or just find a less passive agressive way to fuck with the tow drivers. maybe single out the ones who are actually sharks.

i can't wait to see how this plays out. i'm sure he'll get his car back at no cost to him, but really its going to cause him a headache. he needs to make sure he causes as much trouble for the other parties involved as he has had to deal with. what if he needed his car today? what if he worked a late shift and needed to be at work at 3am? People need to be responsible for their actions. I think he needs to have wolf creek mandated to change all their signs and find some way to claim a loss in revenue due to lack of having a car. maybe say he didn't get to go to work today or tomorrow because he didn't have it and make them pay for 8 - 16 hours of work?

3/7/2008 12:08:46 PM
Ok, so went to Barbours to get my car out. My fucking rearview mirror was crooked... someone bumped it. My permit was on the center console near my shifter, with the reverse side up. Someone fucked with me.Any how, went to the clerks office. What you need to do is file a civil suit, allow the towing company three days to respond to the claim, THEN you can file that form for the release of vehicle. And it cost $75. So, what I did instead was took paperwork to file a suit for monetary damages, which i can get my car now, then pursue getting my $100+$75 back.I'm going to deal with the apt complex now (though manager is out until monday). See if they'll knock it off my rent. If not, I'll likely slap the two of them as co-defendants for the small claims shit for the $175. As well as file a second complaint with the AG's office regarding the refrigerator not being repaired promptly, which i held off since they were extremely apologetic and made sure it was fixed immediately after talking to the manager.Additionally I'm going to file complaints with the Attorney General's office, BBB, and the taxi cab inspector (919-664-5373)... Then at least the criminal aspect will get handled, though it will be tough to prove they broke into my car.Called a judge friend... he said, the fact that I live there makes the sign issue a wash when pursuing the civil aspect (since I'm already aware of the towing policy), but said despite not being able to prove they broke into my car, the fact that the permit wasnt hanging, when there's really no reason to remove the tag might give me a leg to stand on. A reasonable man would not remove the tag from the mirror. [Edited on March 7, 2008 at 4:11 PM. Reason : g]

^ They'll claim the permit tag fell and you'll have a hell of a time proving otherwise. <pipedream>See if you can have the inside of the vehicle dusted for prints to compare to the tow company employees. With some luck, you might be able to get a lawyer and subpoena the employees' prints during discovery if you file suit. You'll have to pretty much pay for and document the investigation process on your own and you'll need a lawyer to handle the advanced paperwork for this kind of thing since you're looking at a process a little beyond the scope of small claims court. </pipedream>

Thank you for standing up for yourself. The only thing you have not done is contacted the news media about it. They compile predatory towing stories for slow news days. Once you go that route your apartment complex might be a little more willing to take care of it vs. dealing with more bad press.
