That's a local company using it to make a profit. I wonder if this would be treated differently..especially if whoever is printing them isn't making a profit (Such as the 'This is not red' shirts)?

If I were making t-shirts like these and wanted to try and completely avoid getting into trouble even if it was illegal to use someone's likeness...

I would donate the "profits" to charity. You could still get in trouble, but if you donate money to something like kids with cancer, it would take a real douchebag to charge you with something.

if you were really on your PR game, you could somehow track down Hansbrough himself with a video camera, and ask him if he minds if the shirts are sold since 100% of the proceeds are going to help combat cancer or something...tell him he's helping a good cause or some shit and put him in a predicament that he can't simply get out of by lowering his head and charging
