devils advocate stance:if the biker was in the wrong (and regardless of right/wrong, he probably shouldn't be riding his bike on a highway), then the lawsuit is justified. How is a biker different from another vehicle on the road? They want equal rights to ride on roads with cars, why should they be given special treatment? They should be liable for damages just as another motorist or motorist's insurance company would be in a similar situation.
