Re: Unauthorized Use of NBC Universal Properties
Notice ID: 14-15942221
23 Jan 2008 18:37:36 GMT

Dear Sir or Madam:

Please be advised that NBC Universal and/or its subsidiary and affiliated companies
(collectively, NBC Universal) are the owners of exclusive rights protected under
copyright law and other intellectual property rights in many motion pictures and
television programs, including the title(s) listed below (the NBC Universal
Properties). NBC Universal diligently enforces its rights in its motion pictures.

It has come to our attention that North Carolina State University is the service
provider for the IP address listed below, from which unauthorized copying and
distribution (downloading, uploading, file serving, file "swapping" or other similar
activities) of the NBC Universal Property or Properties listed below, or portion(s)
thereof, is taking place. We believe that the Internet access of the user engaging
in this infringement is provided by North Carolina State University or a downstream
service provider who purchases this connectivity from North Carolina State
University.

This unauthorized copying and distribution constitutes copyright infringement under
Section 106 of the U.S. Copyright Act. Depending upon the type of service North
Carolina State University is providing to this IP address, it may have legal and/or
equitable liability if it does not expeditiously remove or disable access to the
motion picture(s) listed below, or if it fails to implement a policy that provides
for termination of subscribers who are repeat infringers (see 17 U.S.C. 512).

Despite the above, NBC Universal believes that the entire Internet community
benefits when these matters are resolved cooperatively. We urge you to take
immediate action to stop this infringing activity and inform us of the results of
your actions. We appreciate your efforts toward this common goal.

The undersigned has a good faith belief that use of the NBC Universal Property or
Properties in the manner described herein is not authorized by NBC Universal, its
agent or the law. The information contained in this notification is accurate.
Under penalty of perjury, the undersigned is authorized to act on behalf of NBC
Universal with respect to this matter.

Please be advised that this letter is not intended to be a complete statement of the
facts or law as they may pertain to this matter or of NBC Universal's positions,
rights or remedies, legal or equitable, all of which are specifically reserved.

Please send us a prompt response indicating the actions you have taken to resolve
this matter, making sure to reference the Notice ID number above in your response.

lol carrie levow. she's got a username on here. she's not the bad person here, just the informant saying NCSU got a complaint about you.

stop sharing illegal files, delete your P2P software and then email her back. if anything, you'll get a call from student conduct and lose your internet for the rest of the semester. a mere slap on the wrist compared to what you might face if nc state didn't protect your pirating ass

i got in trouble for using napster back in 2000/2001. i got a very similar email from ms. levow, so i did everything as requested, and I received a response saying my actions were appropriate and acceptable, and I never heard another word of it.

A friend of mine was running a dump, and he got in more trouble... He lost his Internet access for the rest of the semester.

But that's still not that bad compared to an actual lawsuit against him if NCSU would have turned his name over

why the hell didn't i stop by the pirate bay when i was in stockholm this past summer

also, some torrenting programs don't work well (specifically, fast) if you disable uploading...for example, utorrent requires upload set at 6kbps or higher to have uncapped downloading

the more you know

just do what the email tells you to do. fortunately, only RIAA has been suing students. so far. so send a reply via the form, don't get caught again, and hope that NBC/Universal doesn't start going after NC State students the way the recording industry has.

ha. I've gotten two of those letters. Got one fall of freshman year claiming that I had been downloading Walking Tall two weeks after it came out in theater. Granted I did download it but it was a day before it was released in theaters and I had already deleted it before the date I was supposedly downloading it again. Last semester I got an email saying that I had downloaded a movie called swimming pool. Hell, I hadn't even heard of the movie until that email and I still don't know what the fuck that movie is about.

Just send a letter saying that you will delete the copyright material and won't engage in illegal activities. If you wish to continue downloading, go download utorrent, click on preferences and change the maximum upload rate to whatever is the smallest amount that you can still get decent downloads with. You can also download PeerGuardian which has a blacklist of known ips associated with the recording/movie industry.

disable that shit altogether, I'm tellin' you.

in reality just so long as you keep you u/l bandwidth low, you will never have a problem - you are prolly the moron that leaves the shit running day and night with no limits...also, you prolly downloaded your files from a sketchy torrent. peerguardian ftw

we provide names only when subpoenaed for the information. the students in question are notified before their names are released to the RIAA so they have an opportunity to stop the subpoena.

we never give out names unless legally required to do so.

F the RIAA and F the MPAA? AMIRITE?

God I remember in 2000 when I started at State just as Napster was hitting it big. I had only had dialup at home and when I got my computer plugged in and ran that thing the first time on campus, I about came. I was able to download songs in SECONDS! I filled many gigs of HD space with songs because of NCSU and ResNet. Those were the good old days.
