ok. so my parents own a condominium in raleigh. basically we own from the walls in, right? The property management group here says no pets period whether you own your unit or rent it. Can they tell people who own their unit that they can't have pets, since its their property? i have no clue...but im just wondering if there is any way around this??

Seems not, but they could say you can't have it on their sidewalks, their stairs, their grass.

If they signed forms that said they couldn't have pets then it's possible. Lots of time they agree to follow the HOA which may have rules such as that one.

Yes they can enforce it. If they catch you with an animal they can fine you. It sucks I know but the best thing I can tell you is not to live there. If you have a completely indoor cat you will probably be ok since no one outside your unit would ever know. If its a dog go ahead and hang that up. If pets are banned per the covenants then the HOA has the power to enforce that rule.

I'd assume there's a no pet policy per the condo board/hoa covenants? If so, they can go as far as to put a lien on the property.

^ I would break the rule if that was the case, but I would make sure your parents are cool with it since they will be the one technically liable for any HOA fines (assuming your parents are just going to let you live there without a contract).If they ever needed to get in your unit, they normally leave a notice in which you could just take the cat somewhere else for the day.[Edited on January 12, 2008 at 1:45 AM. You can also talk to the HOA and ask for an exemption, because you own your unit.If they aren't dicks, then that shouldn't be a problem.

The HOA will be run by a Board. That is where you would ask.In condominiums, usually private investors own, not the residents. There is a good chance that if you explain your case you can get pet approval.

yeah i talked to the property manager about speaking to the board on the policy. she said it would take a majority vote from the board members to change the policy. apparently someone else has already tried and they said no.

^I lived with my parents in their condo while going to community college in FL. Ended up having to sell the Mazda B2300 pickup truck I owned because the HOA was paranoid that trucks would make their property values take a nosedive . I tried to get permission for it since it was clean, small, and late-model, but they said the same thing: the board had to vote and since the board was made up of 70 and 80 year olds with nothing to do but worry about their investments, they would never approve it.

My HOA threatened legal action because my contractor left a ladder on the porch and they thought that it was unsightly.

HOA's are not supposed to give anyone special treatment, doing so can open them up to litigation from the people they are not playing favorites with.....If there is a chance they might revise a general policy go for it....but in this case it seems they don't want any precedents that animals are allowed at all. If it was me I would just try to live under the radar with the cat.
