Newton Grove — More than $140,000 in cash was seized Thursday afternoon during a routine traffic stop, authorities said.

Members of the Sampson County Sheriff's Office Highway Enforcement Awareness Team pulled over a 1999 Honda Accord on U.S. Highway 701 south of Newton Grove for a window tint violation. The driver tried to flee on foot but was apprehended after a brief chase, authorities said.

A K-9 picked up a scent off the car, and authorities said they found the cash hidden in locations throughout the vehicle. Neither the driver nor a passenger claimed the cash, so investigators seized it under federal forfeiture guidelines, authorities said.

Rigoberto Rivera, 25, of 323 Flowers Road in Mount Olive, was charged with resist, delay and obstruction of an investigation and with taunting a police K-9."


Dude was charged with "resist, obstruct, delay" and lost $140k.

Your lawyer can help you figure out whether the FBI unlawfully seized your money to begin with and whether you have any other defenses to the seizure."

you can legally carry as much cash as you want. How can there possibly be a law against how much money you can have on you? While 140k in cash is very suspicious, it's up to them to prove it was illegally obtained.

Window tint violation? Probably just an excuse to stop & harass. I have illegal window tint and don't get hassled, but I don't drive a chromed-out hooptie and I'm white. Judging by the looks of the Sampson Co. deputies, they probably stop anyone they feel like and act like assholes just for the power trip. I drove through there once on I-40 and they were stopping cars left and right, hiding out in every ditch and around every curve, dressed in their black paramilitary gear, sitting in their own heavily-tinted black unmarked crown vics (which are conveniently exempt from tint restrictions).

This is not true. They can confiscate cash under the pretenses it is involved in drug trafficking and you have to prove your innocence to recover it.

I agree this is contradictory of everything our country stands for but it is Federal Law. There are cases where cattle traders and others who regularly deal only in cash have lost their money and then had to pay attorneys to fight to get a portion of it back.

I do not care if George Jung is pulled and the police find 50K in his glove compartment. They should have absolutely no right to seize the case unless they have credible evidence or witnessed the drug transaction. Even if George has a dimebag in his pocket and gets a misdemeanor drug charge. I have heard this happening in several incidents and absolutely disgusts me.

I knew they could seize the money, but I was under the impression that after seizing it they had to prove you were involved in some sort of illegal activity that was likely connected to the money in order to keep it.
I guess getting caught with a large amount of cash is just about always going to result in you digging yourself out of a pretty deep hole even if it was obtained legally. I read an article once on a guy who worked with a group of professional gamblers and was constantly running large amounts of money across the country. He taped the money to himself under his clothes and was always extremely nervous while going through security. He said something like, "although all of the money was obtained legally, it was not something I cared to explain."

law enforcement agencies have stolen original documents from me. example, my birth certificate has nothing to do with a warrant allowing them to search for cocaine. neither does my license

and i was charged with drivng with out my license on me the next time i left home (pulled within 1/4 mile of home)

never got any of it back, had to pay the ticket

do some research before you talk... you are wrong. I thought the same, but anything over $10K without proof of where it came from and they can seize it. YOU have to prove it is legit...

I'm sure that this is not always the case but generally speaking someone that is smart enough to acquire $140,000 legally is also smart enough to transport the $140,000 in a manner that is not "stash the cash in the car."

Of course since the cash wasn't the drivers I don't see how the seizure really effects him.

possession of a large sum of cash is prima facie evidence that the money is from drugs or some other illegal activity and the burden of proof is on the possessor to show that it's not

umm dude, i ain't american, and even i know you are wrong. above a certain threshold (10k?), they can and do take the cash, and YOU have to prove it was legitimately obtained. and if you can't, well such it up.

go to the soap box for threads on this.

the police makes some millions each year from such seizures.

If I was smuggling drugs something tells me I would not be driving a car with a bunch of after market tint and shit on it. Thats like saying hey mr redneck cop pull me over and fuck with me please!!!!

I would get a construction van and fill it with plumbing tools and shit and drive around with a blue shirt on, then hide the shit behind the tool bins.
