Six months ago my girl friends car broke down on the way to the airport to come see me... Turns out their was a radiator problem that caused the engine to seize. The car was still under warranty; they replaced the damaged parts and from what I understood from the dealership these parts were now under an extended warranty onto themselves (later they recanted that statement). Now a month ago I was driving the car into Boston and the car died on the mass pike. It was then towed to the nearest dealership... The dealership accessed the problem and said that what the dealership in North Carolina botched the repair job. In fact everything the dealership in NC did to fix the car would have to be redone... However, the car is now 3000 miles over the factory warranty and they are refusing to fix it... My gf filed for the “Good Will Claim” and since been denied. However, they did say the best they would do was go in and pay only half of the repairs... My question is... Is it worth pursing legal help? Because the repair bill is will be well over 5000... and she only paid 7000 for the car... Please I need some good advice here…

If you can prove a botched repair job, the original repair shop should be liable for the new repairs if their old repairs were the reason for the current damage.

yep, tell them they will be paying for it, or you will see them in court. 5k is over the small claims limit, so it would be a MAJOR headache for them to deal with. AKA they will probably do the work for free.

The MA dealership said it was the NC dealerships fault. However, they are also claiming the problem should of been noticed well before hand. The car had 2 oil changes before hand an no autoshop ever said anything. The cars check engine light didn't even come on until it was already dying... In addition neither of us ever noticed a problem with it... I am thinking contacting the NC atty general... and filing a claim... however I don't know how long that will take...

i would get the ball rolling instead of messing around on here.if you don't back down and are willing to fight for it, you might win.it'll take a month or so though, unless you slap them with a lawsuit/have a lawyer send them a letter threatening action.

deffinately fight that.The dealer that did the work is liable for anything, generally for one year.

It is a Hyundai, one of the cheapest made cars I have ever seen. I wish it were a Cherokee I could fix it myself with parts from the junk yard… Sadly this car is so cheaply made the parts never make it that far… The only thing holding my girlfriend back on this is the fact she will not have a car… Mine is in storage in NC so we wouldn’t have a vehicle. The dealership gave her a loaner but they are going to want that back soon… I have convinced her to call the Attorney General and report it as fraud… So hopefully something will come out of that… Thanks everyone for the comments…

Update: GF called the Attorney General and said there wasn't much that could be done... The rep said she could file a claim and it could go to small claims court... Because the car was out of the warranty there isn't they are not obligated to fix it... even though it was under a year since the repairs have been done...I still say this is some sort of fraud... Course that could just be my anger...
