I received a Possession ticket about a week ago. Pulled into a gas station that never cards me and my roommate. Walked out with my beer and got into my car, then the undercover cop pulls in and sees my roommate with beer who is also underage and tails me for about a mile and pulls me over. Said he pulled me over b/c my roommate did not look 21 and sees my case in the back seat. The cop was pretty cool about it since I was underage, wrote me and my roommate a ticket and said I had two options: 1. Pay the ticket off but it counts as a misdeamnor($135); 2. Go to court and sign up for this class, complete the class(3 weeks), go back to court and get the charge dropped($235 not including lawyer fees). Any suggestions or ideas on what I should do.

dur, get it dropped - you don't want a misdeamenor on your record. Suck it up - this kinda crap is gay as shit, but it happens, do whatever you can to keep your record (short of infractions like speeding tickets, etc) clean - you don't want to ever have to admit to shit on your record later when you interview for jobs, etc. I had a fake ID for 3 years - was very lucky. Pick your stores wisely and your ID's wiser.

Money spent now will save you $texas later - I have had all my speeding tickets dropped, yes I know it's not the same thing, but to get this dropped for under 500 bucks will be a bargain, could end up NOT costing you a job after graduation.

um no need for a lawyer

when you go to court, talk to the ADA about doing the 90/96 program

please call campus legal services for more info, and they (being lawyers) will serve you better than TWW

That's a bullshit reason. If you are of age, and someone in the car isn't they drill you on who the beer is for. It's ALWAYS just for who bought. They get mad at hell when they can't trip you up.

For you, of course they were cool about it. They got their jollies in writing you the ticket.

Unless I too am drunk, I think both were underage, so technically, both should get a ticket and the store owner/clerk should get a citation for selling to an underage client.

It was always understood by me and my friends when we were under 21 that you put your alcohol in the trunk. Just the logical thing to do if you get pulled over for some BS and then an asshole cop wants to cause problems.

Yea, that's not a hot spot, but certainly not off limits for those guys to lurk, and usually good gas prices there too. Did you have a fake ID, or just an expired one form a look a like, might want to check on that if the latter is the case. Did he charge you with possession only, or possession and the fake?? Pretty sure the class will get you out of both though, but the class is another hundo I think, but I don't think you need a lawyer for this.

dont waste your time with a lawyer. i did that. all you have to do is go to your court date, plead guilty and take the class, then they will either have it dismissed or you can get it expunged. you'll pay court costs + 150 for the class. dont waste your money on a lawyer that is not needed.

This happened to me my freshman year.

Call NCSU legal services, go to court, ask for the 90/96 program, then get it expunged from your record (if it's your first misdemeanor offense).

Annoying as hell, but it's better to get it off your record

i would think that the cop would have stopped you right in the parking lot, carded you, then used you as proof to go into the store and charge the store clerk for selling to underagers. that carries a hefty fine. then, once that was done, ticket you for buying alcohol underage.

two birds with one stone and such

agreed. ive had several of them, and i was still able to get a job that has very tight background checks. don't get it immediately expunged...especially if theres a chance of you getting caught for something worse. you can get it expunged anytime, so wait until you've calmed down to use it.

Seriously, a drinking ticket/alcohol possession will not stop you from getting a job. In fact, any workplace that will not give you a job because you got a drinking ticket in college probably isn't worth working for in the first place.

If you have $300 and you are seriously worried about your record, do it....but I'd save it for something else.

its going to be more than $235 though

mine was court cost + class fee + expungment fee

was about $350 or so

agreed. this really isn't shit on your record. i wouldnt recommend getting it expunged, i was just giving the options. some people flip the fuck out like it's something serious but it really doesn't matter. i would just take the class and get it dropped. you're fine.

damn. how much did you pay for the expungement fee?? i paid about 100 for court costs + 150 for the class. ~250 total

i wouldn't even say the drinking laws and enforcement are even about morality these days. It is a way for the state to make money $$$$.

When you are underage and get caught you are paying the "premium" alcohol tax. The old people get the extra revenue they need. Not saying i agree w/ it but a lot of times underage drinkers are the ones that cause problems when they get drunk. By making it against the law policiticans appIease the mainstream public who gets pissed off at a lot of the ruckus caused by college aged kids partying and they make money.

I think the drinking age should be 18 and i disagree w/ the gestapo style enforcement the same way i h8 how state troopers get off when giving out a $125 "premium highway tax" speeding ticket for some avg joe driving 74 in a 65. Just playing devils advocate in the paragraph above.

The only reason the drinking age being 21 make a difference is because people have practiced drinking for so long that by the time they turn 21 they do less stupid shit. If everyone actually waited until they were 21 they would do as much stupid shit.
