So evidently the owner is back to his old tricks--sorry i know there is a thread buried somewhere but this is more of a call for advice. (excuse the words, but its a good story if you care)So I went to NYP yesterday with my girlfriend and got one student special. I paid with a credit card for a total of $4.50, slashed the line for tip and wrote $4.50 on the total line. This morning Im checking my bank account and just happen to look at my check holds and see a total of $5.62 from NYP. Luckily Im wearing the same jeans as yesterday so I reach in my pocket and pull out the receipt which clearly has $4.50 on it. Usually I wouldn't care about $1.12 but this has happened multiple times to multiple people and I had an 8:05 class this morning after a night at east village and I wasn't happy. I print off the Wachovia check card hold statement and highlight the amount, and walk to NYP right as the store opens. I ask one of the girls for the owner, to which she asks what I want and I show her both papers. She immediately walks over to the owner and says "you overcharged him". He came over and I told him I wanted to see their receipt from my purchase the day before. He stammers around, comes back and says, "No, this is not my fault, it is the bank's fault. I can't help it, they charge money everytime there is a purchase but they will refund it within 3 days." I told him I had never heard of anything like that in my life and had never seen this happen on another charge at a restaurant, including his. I ask him what bank he uses (he says Wachovia) and I tell him that I will call them and ask them if it is the case--but thats when he gets really flustered and says "no, its the credit card company" and I said okay give me the credit card company name and I will call them. He tells me that he doesn't have the contact info for the credit card company. That's when I called bullshit. He starts cussing at me and telling me if i don't like it then I can leave. I retort and he crumples up the papers i brought to show him and throws them in my face. By this time there are about three or four other customers in the store and I start cussing him out and tell him he will be getting a call from the BBB. I walk out and immediately find and call the eastern north carolina BBB where operator tells me that she has never heard of a charge like that from a bank or credit card company. Obviously I dont want my $1.12 back, but this guy has been pulling this shit for a while and is sketchy as hell. She tells me to call the state attorney general to get him put out of business. What are yall's thoughts?(In any case its Sylvia's from here on out)

bad things always happen to good people, even those that eat at shitty pizza places
8/25/2006 11:19:05 AM
he's right...it IS the credit card company/bank/whatever. when it clears it will probably be $4.50 just like you paid for. there are times i go to the bar or restuarant and they "hold" what would be expected if someone left a tip, but when it clears a few days later, it clears with what i actually paid.doesn't excuse him being a dick about it...but he could've been having a bad day. who knows.[Edited on August 25, 2006 at 11:21 AM. if he threw your papers in your face, you need to go talk to the magistrate about assault charges. Has the charge cleared for the incorrect amount, or it just the hold? If so, you shouldn't get your panties in a ruffle until it clears.[Edited on August 25, 2006 at 11:22 AM. Reason : ?]

I ate there the other day and I just checked my bank statement after reading this and mine is only $4.50
8/25/2006 11:21:52 AM
From what I understand, Alot of restaurants "overcharge" to make sure the money is in the account. IE they will charge a standard 15% or something. So when it shows up in pending it looks like its over the amount, but when it actually hits your account its the correct amount. Its the same way with gas stations. They will "charge" a certain amount on your card to make sure you can pay for the gas but it will correct itself when it hits your account.Looks like a selfpwnt. 8/25/2006 11:22:13 AM
yeah good job acting like an ass before it even clears.when its just the hold it means nothing.

haha, it's cool though...i came online, made a thread and got my panties all in a wad the first time this happened with EV. i was all "WTF MATE?!?!" but when it cleared it was fine.

8/25/2006 11:24:50 AM
^ he's right - it's general practice to put a hold on for 15% higher to ensure that whatever may be on the tip line can clear as well. A hold isn't an actual charge it's just a lock on those assets. When the transaction clears and the tip is $0.00 then the actual charge will just be $4.50I'm going to assume that if the owner decided to overcharge he wouldn't pick the random number of $5.62. You just made a complete ass of yourself.
8/25/2006 11:27:21 AM
I had this shit happen to me as well at NY pizza, but in my case i had 2 specials and left $1 tip coming to like $10.01 total. my bank statement said $13.xx when i checked it later that week but thn a few days later it said the actual price i agreed to pay, $10.01.
8/25/2006 11:27:44 AM
hmmm, he's been a dick of a person of three years so I probably didn't give him the benefit of the doubt, but he was sketchy from moment one. It might be a selfpwnt, but he just lost about $texas in purchases from me for cussing and throwing shit in my face. All he had to do was give me the bank/ccc or whatever and I would have called. Ill definitely be watching for that to clear.
8/25/2006 11:28:57 AM
btw, i had this same thing happen at ruckus pizza but i just checked and it's done right now

too many words to readmost credit card purchases show up high at first but after a week or 2 they show up correct. something about the process makes them overcharge you but only temporarily
8/25/2006 11:57:23 AM
^ yupand places like Saucer show up as a flat $50 "Temporary Authorization" on my MBNA card for about a week, regardless of whether i drank $10 worth or $80 worth. After about a week it goes back to the real amount.
8/25/2006 12:01:22 PM
admittedly (though it means little now) I was wrong, but I wasn't a dick about it when i went in. I only started cussing when he threw the shit in my face when I asked him for the named of the credit card company. Either way I got owned two ways: i didn't think he was correct and pwned myself and i got shit thrown in my face and there isn't anything i can do back to him other than not eat there.
8/25/2006 12:05:31 PM
YEAH UNFORTUNATELY YOU WERE WRONG BUT THAT ISN'T HOW YOU HANDLE IT BY THROWING SHIT IN SOMEONES FACE....IF THAT FUCKING GUIDO DID THAT TO ME I WOULD HAVE LITTERALLY GRABBED HIM BY THE THROAT AND TAUGHT HIM A LESSON IN CUSTOMER SERVICE
8/25/2006 12:09:13 PM
I think you should go back and apologize

WOLFPACKKC- i work at a bank. i see this all the time. restaurants always hold more than the purchase until it clears. for someone who checks their bank statements daily and goes to east village, you should have noticed this a long time ago. east village always holds double. good job.[Edited on August 25, 2006 at 12:23 PM. why would i apologize if I was trying to have a civilized conversation and resolve a problem that I didn't necessarily believe him on? he throws shit in my face and I am supposed to apologize to him? if anything i am more angry now about that than I was when I thought i was getting jipped (sp?).^^^Debit card.^East village didn't hold double from last night and my tip hasn't gone through yet.[Edited on August 25, 2006 at 12:34 PM. I'm waiting for the "I *airplane* NY Pizza"
8/25/2006 1:03:55 PM
EITHER WAY, I THINK ALL SHOULD GO TO SYLVIAS......THE GUY IS VERY NICE AND EXTREMELY POLITE AND WELCOMING.WHENEVER I GO TO NYP, THE GUY DOESN'T EVEN FUCKING SMILE OR SAY A WORD. SYLVIA'S FO LYFE, YO
8/25/2006 1:06:00 PM
ny pizza down here is GARBAGE
8/25/2006 1:10:42 PM
FYI, a debit card is even worse. At least if fraud happens with a CC you can just dispute the charges. If they get your debit card #, they can clear out your bank account (still recoverable, but considerably more of a PITA.)
8/25/2006 1:26:52 PM
He might be wrong but he is still the customer....and from what I remember in retail, the customer is always right, even if they are wrong. I personally would apologize but I <3 NY doesn't deserve an apology in this case, IMO.
8/25/2006 1:30:48 PM
That old guy used to hook me up all the time. Free pizzas, he'd make a huge pizza with whatever i wanted just to sell me a slice even when i never asked him to, major discounts if i was buying a couple pizzas at a time, etc..He owns the place, he can be a dick to whoever he wants. Try owning a restaurant and having to kiss ass to every person who walks in the door because the customer automatically expects they'll get whatever they want. You'd get sick of their shit after a while too
8/25/2006 1:34:53 PM

here's what you do...1) dont pay for 4.50 purchases with a credit card.2) go back in there with some petstore mice, and release those motherfuckers in the back near the bathroom...they will make their way to the front and customers will freak/sue. etc.
8/25/2006 1:47:11 PM
Businesses that don't promote customer satisfaction deserve to go down in a pile of flames.
8/25/2006 1:59:19 PM
Seriously, everyone should go to Sylvia's. He's cool as hell and doesn't charge for tax sometimes.
8/25/2006 2:10:41 PM
I  "I  NY Pizza" and the "pizza natzi"... I went to Sylvia's once and it was horrible. I've been to I  NY PIZZA at least 50 times in my college career and it's always great. Amore's isn't too bad either though...
8/25/2006 2:18:53 PM
Amore's is far and away the best place to eat. More than just having good pizza, it's actually enjoyable to hang out in
