Anyone who's thinking about renting from Hailey Properties better be careful -- take pictures of everything when you move in and keep a careful checklist of existing damage. Make your complaints and requests for repairs via certified mail, because lots of phone calls to HP don't get returned and lots of mail sent to HP gets mysteriously lost. HP has been taken to small claims court several times for not returning security deposits. Rhyne management sux also, I'm not sure about my deposit yet, I will know monday hopefully!!! They never fixed anything!!!

I have always gotten the feeling the Hailey was a slum lord.

Mostly from the condition of his properties.

I was very happy with Rhyne for about two years, but then the maintenance went to shit. I did get my full deposit though.

Send them a letter explaining that you want your deposit back and that if you are not given a full refund within 7 days you will be contacting

1) Minimal Housing of Raleigh for many of their properties

2) A lawyer to sue them for your Deposit and lawyer fees (Which is allowed as long as under $10,000).

DO NOT CALL THEM. Send them a letter that includes the above and your name and a perm address they can send the check to. If they do not respond within 1 week contact a lawyer to send them a letter. This will cost you about $100. ASk him to include his lawyer fees in the bill and if they STILL do not respond after you consult a lawyer...

Go through with your threat. You'll win. You have NO IDEA how hard it is for a property owner to prove that you are not deserving of your deposit. 99% of the time they'll cut their losses at the first stage. Renter's have insane rights in Raleigh.

- Complete pre-move-in checklist in detail
- Dont damage unit
- DEMAND that the manager meet you in person to conduct a move-out walk through to note any damage, if they refuse document it in case you have to sue them later, have them sign something saying what the damage is if anything at the walk through. This will cover your ass.

Otherwise you have to take it to court, and by then someone else has moved in and you have no proof.

Wilson Properties sucks as well, after two years they tried to charge us to repaint, new countertops, and actually charged us for the film for them to take pictures of the "damage"

For the sake of reference for the rest of us, can you point out where we can see these rights (i.e. link to the proper general statute(s) )? I ask because I work in property management, and I can tell you that any given management comany will write the leases to cover them very well, including a host of clauses to keep a deposit. Not saying you're wrong, just looking for confirmation.

I do know that holes in the walls from hanging shit in the house & travel wear on carpets is part of normal wear & tear, so don't let them give you any shit about the holes in the walls. DO make sure you clean the place before you go.

And they do that, in hopes that they'll get lots of tenants who don't know the law.

If you don't know your rights, how can you claim them?

Just get a copy of the City of Raleigh Renters Rights that Minimal Housing has. Renters have certain rights that you cannot take away via a lease agreement. If a renter fights you about a deposit and you don't have VISUAL proof of damage they caused you lose. The Judge doesn't even listen to the case most of the time. This happened to my mom once.
