here's some more analysis and a quote from the hearing, or whatever it washttp://arstechnica.com/news.ars/post/20060215-6190.html

They're eventually going to litigate to the point of destroying their own industry. That's just idiocy.I wonder how they'd try to even enforce this. Are they going to deploy agents around the country to seize and search people's iPods? That'll fly.
2/16/2006 10:04:45 AM
they've yet to stop music piracy and this wont help.Like all content holders they're completely fucking incompetent.Instead of using these technologies to provide superior content distribution, they're alienating their customers.Who the fuck runs these companies? Its like they've been out of touch with society for the last 10 years.
2/16/2006 10:08:33 AM
The problem is that when their revenues fall they will not make the connection that it is their own policy than damns them and step up the efforts.Someone is going to loose big here and I just hope it isn't us (the consumer).
2/16/2006 10:11:09 AM
I think they just turned it up to 11.
2/16/2006 10:15:01 AM
we wont loose at allthey dont have any new musical content thats worth listening too.and we obviously dont need their distribution system to get anything.

replacements availible on teh intarweb for $free
2/16/2006 10:48:18 AM
I'm dead serious, where the fuck are they talking about readily available at affordable prices. If they are meaning entire new CDs then I am going to hit an entire new level of furious.
2/16/2006 10:51:20 AM
From the RIAAs own website
2/16/2006 10:54:13 AM
2/16/2006 10:56:00 AM
this amuses me...their litigation threats are pretty meaningless anyway...sure, they DO catch some people, and they make a huge deal out of it, and of course the person they catch is kind of screwed...but there are far too many people for them to find and prosecutetheir only hope is to embrace it and hope for the best
2/16/2006 11:02:27 AM
"someone h4xed my ipod i dunno how those songs got there"
2/16/2006 11:19:21 AM
That brings up another point.CD is an obsolete medium. CDs are too big, too delicate, and offer an unacceptable level of portability (in 2006).
2/16/2006 11:22:43 AM
RIAA: "profits are only up 5% this year instead of the 10% we wanted! damn those pirates!!!!"
2/16/2006 11:50:21 AM
so lets say RIAA wins this..I see CD sales plummet to almost nothing.. most people will want to buy MP3's online so they can still use their mp3 players whenever/whereever they want.. and not have to carry a bunch of cd's around just to listen to music.Unless they deem online mp3 sales illegal as well.. then we can all say goodbye to music (well most of it)... and resort to television and movies for all our entertainment..
2/16/2006 11:59:28 AM
this is damn near the stupidest thing i've heard so far this yearif cd prices were "affordable" people would still be buying cd's instead of illegally downloading music[Edited on February 16, 2006 at 12:16 PM. Reason : ]
2/16/2006 12:14:13 PM

What I also find interesting (as the article pointed out) is they have the ability to basically change the rules as they go along. If I have to agree to a EULA before I purchase a CD, so be it, but I want to know EXACTLY what I'm agreeing to before I consent to it.Anybody interested in starting up a profitable overseas market in the next few years? I would LOVE to be the company that contracts with the RIAA for the "replacement" CDs.
2/16/2006 12:21:10 PM
^^It's sad, but I could see that happening. Or what will happen is that they will double charge people for music. For example, I tried Rhapsody for the free week trial, because one of my friends had it and it seemed like it would be alright to pay a monthy fee and then have access to almost all the songs I could want. Was that how it worked? Absolutely not.Not only did they only have about 60% of the songs I was looking for, they would require ANOTHER purchase to listen in full to some songs I wanted. They had a "30 second preview", but if I wanted to hear the whole song I had to pay $1. And to BURN that song I had to pay another $1. Eventually the RIAA is going to just spiral into self destruction in which the ownership of music without concent from the band itself is illegal, and no one will listen to them anymore.
2/16/2006 12:21:24 PM
2/16/2006 12:42:39 PM
there will always be a way around paying for musicthey may never be as forefront as napster, but as soon as the RIAA tries to plug up one hole another one will become available
2/16/2006 12:53:37 PM
So hypothetically speaking, what is the best online music previewing software today for single serving mp3s. I heard bearshare...true?
2/16/2006 12:59:11 PM
i like shareaza for quick grabbing individual songs.
2/16/2006 1:02:22 PM
is it encrypted?
2/16/2006 1:06:33 PM
what are you encrypting?

i, for one, wont be happy until all of my albums cost 50 bux a pop. then ill truly appreciate the music i buy.on a more serious note, you'd think apple and other major mp3 player producers would have something to say about this. [Edited on February 16, 2006 at 4:17 PM. Reason : ..]
2/16/2006 4:15:44 PM
as soon as apple starts shit the content companies pull the plug on the ITMS
2/16/2006 6:44:02 PM
^^ they know people will still do it anyways, just as they know people will still download illegal mp3's. They don't really care about either of those. iTunes was never meant to be a money maker, just a tool to push the ipod (although I think they probably are making ass-tons of money off it.)
2/16/2006 6:47:55 PM
eh i wasnt talking about itunes. granted ppl will still do it, but if the only legal way they can get music to their player is through mediocre online offerings you'd think it might hurt the sales of players in general. not that this will work out for the RIAA anyway, but its a thought.
2/16/2006 7:16:18 PM
If ripping cd's becomes illegal, people will still do it unless it becomes difficult. If they somehow managed to put some copy protection in place that actually made it difficult to rip cd's, cd sales would plummit and even more people would turn to online sources, and probably not legal ones.If however they managed to make ripping cd's illegal, put effective copy protection that kept up with people cracking it, AND found an effective way to shut down or discourage illegal music downloads, then mp3 player sales would plummit. I just don't think they can do any of those, let alone all 3.
2/16/2006 8:58:27 PM
this will not hold up in court. Especially since the RIAA in a previous court case said it was alright to make a digital back up copy
2/16/2006 9:24:56 PM
this will not hold up in court. Don't get your panties in a tangle.we already knew the RIAA is a group of money-hungry suits. Why does any of this suprise you guys?
2/16/2006 9:34:56 PM
They've always been ineffective. They scare some easily spooked people out there... but meh.
2/16/2006 9:37:13 PM
So how long before the RIAA starts charging guitar players a $1 a pop every time they want to play their favorite song?
2/17/2006 10:36:12 AM
2/17/2006 10:54:35 AM
compressed =
2/17/2006 11:17:32 AM
^^ works ok sometimes...lots of stuff they don't have, though^man, it's good enough for my ear, esp for the price
2/17/2006 11:41:34 AM
The only reason I wont buy music online is they only sell it in some bullhsit ass format like WMA that has copy protection. I got 3 pcs an ipod and want to be able to burn cds. I would not be above paying for a subscription service if you could actually download the songs and then do what you want with them.
2/17/2006 12:22:07 PM
http://www.allofmp3.com is straight up mp3 format, when it downloads it makes a artist folder, album sub folder/ song
2/17/2006 12:59:54 PM
2/17/2006 1:03:06 PM
I use them for my classic rock collection and early 90's grungebout all thats good anyway, new shit != goodonly downside is theres no underground stuff for the most part, but the upside of that is, thats what you can still find in music stores pretty cheap [Edited on February 17, 2006 at 1:05 PM. 2/17/2006 1:04:56 PM
allofmp3 has a good selection and you can choose the format and bitratekeep in mind its illegal though
2/17/2006 1:12:38 PM
^ maybe for them, not for me, i pay for it
2/17/2006 1:18:17 PM
Fuck the RIAA. 99% of the shit I have on my hard drive is really hard to find on Napster/Rhapsody/itunes. Where am I supposed to get it?
