Sued school b/c of wrongful suspension and won. Aparrently judicial boards that don't allow you to defend yourself and confront your accusers aren't legal?

what the fucking hell?

who cares if it was 2 days after 9-11? Maybe that was his way of dealing with tragedy? i hardly see how these two events are connected, except in a "9-11 changed everything!!!11" mentality

2 days after 9-11 the mentality was that everything WAS changed by 9-11


and they probably mentioned it because it was probably a group gathering dealing with 911 or something to that effect.

^ right. It's like streaking at a funeral. Streaking is offensive anyway, but when you add people who are grieving on top of that, it makes the offense worse.

Exactly. Very little justice comes out of student courts---that's why, historically, they aren't very visible. Students often have the presumption of guilt, not innocence, and don't have many, if any, of the rights of the accused that one would have in the US legal system. For example, let's say a public safety officer searches a student without permission or probable cause and finds contraband. The legal case [city/county] will be dropped because the evidence was obtained illegally, however, in student court, the evidence is still admissible, thus the student gets in trouble despite having their rights violated in the process.

(this is not about 9/11, so shut up about it....)

I dont know, i'd say some student courts are sketchy some arent.
I was on housing's judicial board for a bit, and i definately dont think we were sketchy.

Then again, you *did* get to come in and defend yourself, or defend what you did, for the things we saw. If you didnt show up it went to some non student council to be handled. You didnt get to "face" your accuser but, then again, the "accuser" was an RA or security officer and we got their report which you could read and argue about.

In real court that is called hearsay. Why shouldn't people facing student "courts" have much of the same rights? The state (assuming that the school is a state school) is still doing something to punish the student.

Well remember, this is just a trial court ruling - it has not been reviewed on appeal yet, and I suspect it will be.

I reaffirm, however, my belief that this was a good result. Someone who is defending against a traffic ticket has many due process rights, including the right to confront the accuser - I don't see why someone who is facing expulsion from school should have fewer due process rights. In today's economy, a college degree is pretty much a prerequisite to a successful job.
