Well, they're human too.

but there's a difference between "messing up" as far as making a mistake, and negligence. If a dr. is truly negligent, then he should get sued. But if he did his due diligence but was still wrong about something, I don't think a lawsuit is warranted.

anyway, i don't know your situation, but from the sounds of it ("probably don't have a case") i'd guess it wasnt negligence.

i was mislead about what tests were being done and it led to serious injury
it was negligance

i just need to talk to one of them and see if there is enough evidence to prove it

Patrick Williams is a good friend of mine, and a good attorney who might be able to help you. We went to law school together, and he is a State grad too.

This is what gets to me:
Most doctors have the goal of trying to improve a patient's life. Sure, doctors are human and are capable of making mistakes, but what other people don't realize is that everyone's body chemistry is different. That's why some people fare better with some antihistamines and not others; this is true of depression medicine as well. So when we have people out there trying to sue their doctor who most often wish the well being of their patients, the doctors are too scared to do anything anymore

it would take longer than that for the case to go to trial. hell even an out of court settlement would still take years.

are you really pre-med? was/is there a pre-med major? dentists have it almost if not just as hard as doctors. their medical malpractice has gone straight up for the past couple of years.

Ya, I was pre-med and switched over to pre-dent. Dentists really do not have an issue with malpractice...it's more on the doctor's side. That's one of the main reasons why i switched over to avoid the headache of frivolous lawsuits. It is true that the malpractice insurance for dentists have sky rocketed.

Malpractice insurance is expensive, but the average doctor still takes home close to $200,000 after paying it.

Med Mal insurance only accounts for 2% of all health care spending. Its not keeping people away from medicine.

Its very hard to actually win/bring a med mal case. Its not malpractice just because a doctor did something another would not have done.

Doctors are doing their best to greedily drive up our healthcare costs too. They aren't exactly out there to serve humanity.

Greedy doctors and greedy patients makes it a balanced eco-system.

The cases that I have personally read that had huge judgements all had a few million dollars worth of medical bills and lost wages to make up for. Some of the figures that I have seen for a Ruptured Disk range from $65,000 - $150,000 for the procedure.

I guess there aren't that many dentists who do it b/c they want to help people. I know a few guys who are independent, don't charge an arm/leg and give great service, but they don't make anywhere near $200k.

Our lawyer informed us that the case needed to be filled before the 3 year period was up...not saying it would only take less than 3 years to go to court and close the case.

I have come to realize that every man's worst enemy is a lawyer because they can mess your life up so much. I couldn't handle a case in which I knew that my client was just out to make money.

Alright, how about I make a radical proposal....We eliminate all health care workers and we all start dying at the age our ancestors died at...say 30's, early 40's? So while you all bitch about how some doctors can be humans at times and threaten to sue the shit out of them, that's a great way to reward the health care system for their efforts to improve our lives and extend our life expectancy.

I can see suing the doc for gross negligence, but generally speaking if you aren't dead, paralyzed, or seriously inhibited as direct result of something the doctors did you probably don't (or shouldn't) have a case.

My prediction is that in the next 10 years, the medical field will experience serious setbacks. This is because while potential medical students who are highly qualified switch over to dentistry, the medical schools are forced to select less qualified students and as a result, the advancement of medicine will slow. So while those few individuals win these massive malpractice suits, more and more potential pre-meds switch over and pursue dentistry, and our healthcare will ultimately suffer because of these few selfish individuals.
