Around Halloween time, many of you will be throwing parties. Many of those parties will be broken up at the whim of two or three police officers. The reason they can do this is because of the NPO – the Nuisance Party Ordinance. The Raleigh City Council passed the Nuisance Party Ordinance in 2000 to discourage destructive, obstructing and unlawful behavior intermittently displayed by college students at social gatherings. We believe that this ordinance not only redundantly criminalizes offences that are already illegal but also criminalizes behavior that is protected by the Constitution – namely your First Amendment Right to assemble. If your party is broken up and/or you receive an NPO citation please contact the ACLU at NCSU as soon as you can. (http://clubs.ncsu.edu/aclu/complaint.htm)Our chapter will evaluate each case individually and may refer you to a free legal assistant. If you choose not to appeal your citation for whatever reason, you can come and vent at the NPO forum on November 8 at 7pm. Don't get me wrong -- the NPO is pretty stupid.But, in my experience, most people who get worked up over it are ever stupider.
